APSS- KGBVs – Implementation of orders issued in Single Judge in Hon’ble High Court in W.P.No. in 15245 of 2023 – Engagement of PGTs (Telugu & English) in KGBVs Certain Instructions- Issued.
- The
attention of all the District Educational Officers &Ex-Officio Project Coordinators,Samagra
Shiksha,and Additional Project Coordinators in the State is invited to the
references cited above it is hereby informed that in obedience to the observations
made in the writ appeal no.288/2024,the Government is intended to implement the
orders passed in favou of the petitioners in the writ petition no.15245/2023.
- . The
operative portion of the orders passed in theW.P.No.15245 of 2023 filed by 51
PGTs (Telugu and English),whose services were withdrawn in terms of the
Proc.Rc.No.SS-21021/84/2022-IED&KGBV-SSA,dated 29.03.2023 is herewith
detailed below:
a)
1.The action of Respondents No.5 to 110 in
attempting to discontinue or disrupt the services of the petitioners (PGTs
teaching Telugu and English) is declared illegal and arbitrary.
b)
2.The respondents are directed to continue the
services of the petitioner’s in terms of their respective agreements.
c)
3.The respondents are further directed to
consider the entitlement of the petitioners even after the completion of the
agreement for the academic year 2023-24, as long as the scheme continues to be
in force.
- Accordingly, it is brought to notice that, out
of the 51 petitioners,15 petitioners have already been engaged under the 2023
recruitment process and are currently working in various KGBVs across the State.
In view of the same, the remaining 36 petitioners (List enclosed) were to be
engaged in terms of the contractual terms of 2023 in existing vacancies in
Type-III KGBVs.
- 4. In
view of the above, all District Educational Officers &Ex-Officio Project Coordinators
and Additional Project Coordinators are hereby directed to engage the 36
petitioners (list enclosed) at appropriate clear vacant positions in Type-IIl KGBVs,
based on their respective subject methodologies, purely on contractual terms
and conditions. It is also informed that their contractual engagement shall not
confer any right of regular appointment in future under any circumstances.
In view of the above, instructions are
herewith issued to take all steps expeditiously and report compliance to this
office for onward submission to the Hon'ble High Court
